What it means
This test is written in months, so a day count is only an approximation. We flag you as close well before the line.
Keep the record
Whatever the rule, the person claiming not to be a resident usually has to prove it. Log every day, including travel days, and keep the receipts, boarding passes and photos that back it up. What auditors ask for.
States with the same kind of test
- Alabama: more than 7 months
- Arizona: more than 9 months
- Arkansas: more than 6 months + home
- Kansas: more than 6 months
Questions
How many days can I spend in Colorado without becoming a resident?
If you keep a permanent home in Colorado and are in the state for more than six months of the year in total, you're treated as a resident. Days alone aren't the whole story: domicile is a separate test.
Does a partial day in Colorado count?
Most states with a day test count any part of a day in the state. Check the state's guidance for its exceptions.
