What it means
This test is written in months, so a day count is only an approximation. We flag you as close well before the line.
Keep the record
Whatever the rule, the person claiming not to be a resident usually has to prove it. Log every day, including travel days, and keep the receipts, boarding passes and photos that back it up. What auditors ask for.
States with the same kind of test
- Alabama: more than 7 months
- Arkansas: more than 6 months + home
- Colorado: more than 6 months + home
- Kansas: more than 6 months
Questions
How many days can I spend in Arizona without becoming a resident?
Spending more than nine months of the tax year in Arizona creates a presumption that you are a resident. Shorter stays don't create the opposite presumption. Days alone aren't the whole story: domicile is a separate test.
Does a partial day in Arizona count?
Most states with a day test count any part of a day in the state. Check the state's guidance for its exceptions.
